1. Scope and General Information

These General Terms and Conditions (GTC) apply to all orders placed via the online shop of BROKEN SYMBOLS, located at Ostring 10i, 50129 Bergheim, Germany (hereinafter "we", "us", or "BROKEN SYMBOLS"). By accessing or using our website and Services, you agree to be bound by these terms.

2. Contract Partners and Conclusion of Contract

2.1. The purchase contract is concluded with BROKEN SYMBOLS.
2.2. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order.
2.3. By clicking the "Buy Now" or "Complete Purchase" button, you place a binding order for the items in your shopping cart. The contract is concluded when we accept your order by sending an order confirmation via email immediately after receipt of your order.

3. Print-on-Demand and Specifications

3.1. Please note that our products are Print-on-Demand. This means each item is uniquely manufactured specifically for you after your order is confirmed.
3.2. Minor variations in color, positioning of the print, and material may occur due to the nature of the printing process and digital display settings. Such variations do not constitute a defect.

4. Prices and Payment

4.1. The prices stated at the time of the order shall apply. All prices include the applicable statutory value-added tax (VAT) where applicable.
4.2. Shipping costs are calculated separately and displayed during the checkout process. 4.3. We offer various payment methods (e.g., Credit Card, PayPal, etc.) provided by Shopify Payments. We reserve the right to exclude certain payment methods in individual cases.

5. Delivery and Shipping

5.1. Delivery times consist of production time (on-demand manufacturing) and shipping time. Estimated delivery times are provided on the product pages.
5.2. If a product is unexpectedly unavailable despite the conclusion of a contract, we will inform you immediately and refund any payments already made.
5.3. For international orders, customs duties, taxes, or import fees may apply. These are the sole responsibility of the customer.

6. Right of Withdrawal (Cancellation Policy)

6.1. Exclusion of Right of Withdrawal: According to § 312g para. 2 no. 1 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
6.2. Since our products are manufactured on-demand specifically for you, there is no right of withdrawal for change of mind or incorrect size selection.
6.3. For non-customized items (if any), the standard 14-day withdrawal period applies as stated in our separate "Right of Withdrawal" policy.

7. Warranty and Liability

7.1. Statutory warranty rights apply. If an item is defective (e.g., misprint, damaged goods), please contact us at info@brokensymbols.eu with photos of the defect.
7.2. BROKEN SYMBOLS is liable for damages caused by intent or gross negligence. For slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations).

8. Final Provisions

8.1. The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
8.2. If you are a merchant or a legal entity under public law, the place of jurisdiction for all disputes arising from contractual relationships between us is our place of business.
